What information we keep

What information we keep

We only keep what we need to care for you safely.

About you

  • Your name, address, date of birth and phone number

  • Your NHS number and the name of your GP

  • Who to contact in an emergency, and anyone who helps you make decisions (like a Lasting Power of Attorney)

  • Who pays for your care, such as Essex County Council or you

About your health and care

The law calls this “special category” information. It gets extra protection.

  • Your care plan and risk assessments

  • Your medicines, and when we help you take them

  • Your health conditions and allergies

  • Notes our carers write at each visit

  • Accidents, incidents and any worries about your safety

  • Your religion, culture and language, if you tell us, so we can care for you in the way you want

About family and friends

If you are a family member or friend, we keep your name, how you are related, and how to contact you. We also keep notes of things you tell us about the person we care for.

Why we use it, and our legal reasons

Why we use it, and our legal reasons

We use your information to:

  • plan and give your care safely

  • help you with your medicines

  • keep you safe, and tell the right people if we are worried about you

  • work with your GP, nurses, hospital and social worker

  • arrange visits, and bill the council or you for your care

  • meet the rules set by the Care Quality Commission (CQC)

Data protection law says we need a legal reason to use your information. These are ours:

What we do

Our legal reason

Care paid for by the council

Doing a public task, because the council arranges your care under the Care Act 2014 (UK GDPR Article 6(1)(e))

Care you pay for yourself

Our contract with you (Article 6(1)(b))

Reporting to CQC, safeguarding, keeping records

Following the law (Article 6(1)(c))

Health and care information

Giving health and social care (Article 9(2)(h))

Photos or quotes about you, for example on our website

Only if you agree. You can change your mind at any time (Article 6(1)(a))

We never sell your information, and we never use it for marketing.

Where we get it from

Where we get it from

Most of it comes from you, or from people you trust like your family. We also get information from:

  • Essex County Council, when they ask us to care for you

  • your GP, district nurses, hospital or pharmacy

  • your GP record, through GP Connect (see below)

Looking at your GP record (GP Connect)

Looking at your GP record (GP Connect)

GP Connect is an NHS service. It will let a small number of our staff look at part of your GP record, inside Birdie, the secure system we use for care records.

We are setting this up, and it is not running yet. We will update this page before it starts.

When it starts:

What they will see: your current and past medicines, allergies, health problems and vaccinations.

What they will not see: notes from your appointments with your GP.

Why: so we always have the latest list of your medicines and allergies. This helps us avoid mistakes and means we don’t need to keep ringing your surgery.

Who will be able to look: only staff our Registered Manager has named, and only for people we care for. Every look is recorded, and we check those records.

What we cannot do: we cannot change your GP record. We will only use it for your direct care, never for anything else.

When it starts, if you don’t want us to see your GP record, tell us or your GP surgery. It will not change the care we give you. We will just get the information another way, for example by asking you or your GP.

Who we share it with

Who we share it with

We only share what each person needs to know. We may share your information with:

  • your GP, district nurses, hospital and pharmacy

  • Essex County Council, if they arrange or pay for your care

  • the Care Quality Commission (CQC), when the law says we must tell them something

  • safeguarding teams or the police, if we think you or someone else is at risk of harm

  • your family, or the person who helps you make decisions, if you agree or the law allows it

Some companies run systems for us, such as Birdie, our care records system. They can only use your information to provide that service to us. They must keep it safe and cannot use it for anything else.

We send health information securely, for example by NHSmail.

How we keep it safe, and for how long

How we keep it safe, and for how long

  • Your records are kept in secure systems. Only staff who need them can see them.

  • Carers can only see the people they visit.

  • Staff are trained in keeping information safe when they start, and every year after that.

  • We are checked every year by the NHS Data Security and Protection Toolkit. Our latest result is “Standards Met”.

We keep your care records for 8 years after our care for you ends. Then we delete them securely. We keep complaints for 3 years after they are closed.

Your rights

Your rights

You can ask us to:

  • show you the information we hold about you, and give you a copy for free

  • correct anything that is wrong

  • delete or stop using information. We will say yes if we can, but the law sometimes says we must keep care records

  • send your information to another care provider

To ask, contact us using the details at the top of this page. We will reply within one month. We may ask you to prove who you are first.

A family member can ask on your behalf if you agree, or if they have the legal right to make decisions for you.
